A new academic analysis published in Intereconomics finds that 85 percent of Europe's known critical mineral deposits lie within or near environmentally protected areas, and that community opposition, not geology or economics, has become the decisive barrier to operationalising the EU's Critical Raw Materials Act. With the 2030 benchmarks already slipping and China tightening its grip on refining, Brussels faces a structural contradiction it has so far declined to name: the land it needs to mine is the land it has promised to protect.
Introduction
The road into the Barroso highlands in northern Portugal winds past granite farmhouses and terraced vineyards that have been worked by the same families for centuries. On a clear morning you can see the Serra do Gerês national park cresting the ridge to the north, its slopes still deep green in a continent increasingly anxious about what lies beneath the soil. Savannah Resources has spent years trying to persuade the communities of Covas do Barroso that their land holds something more immediately valuable than wine and scenery: a lithium deposit the company says could produce 200,000 tonnes of spodumene concentrate a year by 2027, feeding the battery factories that the European Union insists are the foundation of its industrial future. The consultations have been held, the impact studies filed, the political support marshalled from Lisbon and, to a degree, from Brussels. And still the project does not move.
The Barroso story is not exceptional. That is precisely the point. A new academic analysis published this spring in the journal Intereconomics, authored by researchers from the International Raw Materials Observatory in Brussels, the University of Pecs, the European Association for Local Democracy in Strasbourg, and the Lisbon consultancy Generator, has put a single, arresting number on what planners and project developers have been quietly muttering about for years. Drawing on data from the Horizon Europe CIRAN project, the paper finds that 85 percent of Europe's known critical mineral deposits sit either beneath environmentally protected areas or within five kilometres of their boundaries. The figure is not, the authors are careful to note, an outlier situation requiring site-by-site exemptions. It is, they write, "the structural reality."
For the European Commission, which formally enacted the Critical Raw Materials Act in May 2024 and has since committed billions of euros to accelerate extraction, processing, and recycling of the materials it regards as essential to the green transition, the number amounts to a quiet crisis. The Act sets ambitious 2030 benchmarks: at least 10 percent of EU annual consumption to come from domestic extraction, 40 percent from domestic processing, 25 percent from recycling, with no single third country supplying more than 65 percent of any strategic material. The gap between those targets and what is actually being approved on the ground is, by almost every independent measure, widening rather than closing.
A Law Built on Sand
Regulation (EU) 2024/1252 entered into force on May 23, 2024, after a legislative journey that began in earnest with Russia's invasion of Ukraine and accelerated through a succession of Chinese export control announcements that made the continent's mineral dependencies feel suddenly, viscerally dangerous. The Act identifies 34 critical and 17 strategic raw materials, requires member states to establish national exploration programmes within a year of enactment, and promises to slash permitting timelines: 27 months for extraction projects with strategic designation, 15 months for processing and recycling facilities, compared to the five-to-ten-year odysseys that currently consume most project developers' working lives.
On paper, the framework is among the most ambitious industrial policy instruments the EU has ever produced. In practice, the European Court of Auditors published a special report in February 2026 that described the architecture as something considerably less than "rock-solid." The auditors found that four strategic raw materials central to the energy transition, specifically lithium, magnesium, gallium, and rare earth elements, already exceed the 65 percent single-country dependency threshold at the processing stage, meaning the CRMA's own ceiling has already been breached before the first domestic strategic project has reached full production. The Commission's recycling targets were characterised as "overly vague," and a commitment made in 2021 to produce sustainable financing taxonomy criteria for the mining and extractive sectors had, by the time of the audit, still not been fulfilled, four years on.
The auditors also noted a more procedural embarrassment: the CRMA requires at least four calls for strategic project applications annually from 2025. By November 2025, the Commission had launched exactly two. The first call drew 170 applications; the second, which closed in January 2026, attracted more than 160 proposals. The appetite from industry is clearly there. The administrative machinery to process it, less so.
Benchmark Mineral Intelligence, which tracks the gap between political ambition and physical supply, put numbers to the shortfall in June 2025. On current projections, the bloc is on course to miss its domestic extraction or processing targets for every critical material except lithium and nickel mining. The EU currently processes about 25 percent of its lithium requirements domestically, against the 40 percent target; flake graphite stands at 20 percent; manganese at 36 percent. On recycling, lithium sits at 22 percent against the 25 percent benchmark; manganese at just 14 percent. The trajectory, absent a significant acceleration, points clearly downward relative to where the benchmarks require European industry to be in less than four years.
The Geography of Refusal
The CIRAN project's finding about the 85 percent overlap was first circulated in academic circles through presentations at the European Geosciences Union General Assembly in Vienna in April 2025, where Vitor Correia and W. Eberhard Falck, two of the Intereconomics paper's five co-authors, laid out the spatial data underlying what they called a "profound disconnection." The mapping exercise cross-referenced the European Environment Agency's database of protected sites with the EGDI mineral occurrence points dataset, which catalogs known critical raw material deposits across the continent. The result was unambiguous: the places where Europe's minerals are concentrated are, overwhelmingly, the places that European law and European citizens have decided should not be industrialised.
The Nature Restoration Law compounds this pressure. The legislation requires the restoration of at least 20 percent of EU land and sea areas by 2030, the same year the CRMA benchmarks fall due. Separately, EU biodiversity frameworks are pushing toward protecting 30 percent of European territory by the end of the decade. As the Intereconomics authors observe, these are not merely competing policy objectives; they are competing claims on the same physical landscape, and in most cases the landscape is not large enough for both.
The paper is disciplined about what kind of opposition is blocking projects. The authors explicitly reject the NIMBY framing that Brussels officials and some industry representatives have reached for when explaining delays. What they describe instead is a structural misalignment of incentives and burdens: the benefits of critical mineral extraction, measured in battery factories in the Rhineland or magnet plants in France, accrue to distant corporations and to EU-level policy objectives. The costs, measured in blasted hillsides, altered watercourses, and decades of industrial activity, fall on specific valleys, specific villages, specific watershed communities. "The decisive constraint," the paper states, "is not what can be mined, but what will be accepted to be mined."
The case studies are spread across the continent. In Serbia, Rio Tinto's Jadar lithium project drew mass street protests that paralysed the country's politics for months; the EU-Serbia partnership on sustainable raw materials, battery value chains, and electric vehicles, signed with evident fanfare in Brussels, was met by local civil society with accusations that the EU was simply laundering community opposition behind diplomatic language. In France, the Echassières lithium project in the Allier has navigated objections about water use and landscape impact. In Romania, the Rovina project remains contested. In Germany, the Zinnwald lithium venture and its cross-border Czech counterpart at Cinovec, which sits atop the EU's largest identified hard-rock lithium resource, have both encountered the institutional and social friction that the CRMA's accelerated permitting timelines were designed to dissolve but have not.
More than 60 civil society organisations and Indigenous peoples' movements called on the EU to enshrine stronger human rights protections in the CRMA before its enactment. The final regulation requires "meaningful engagement with local communities" for all strategic projects, but as the Intereconomics paper dryly observes, the text "contains little detail on what makes a process meaningful."
Three Billion Euros and the Arithmetic of Inadequacy
The European Commission's response to the growing evidence of implementation failure has been institutional and financial. On December 3, 2025, it adopted the RESourceEU Action Plan, presented by Commission Vice President Stéphane Séjourné as "an engine of our industrial sovereignty" and "a cornerstone of Europe's economic security." The plan commits to mobilising up to three billion euros in EU funds within twelve months, channelled through InvestEU (up to two billion euros), the Innovation Fund (at least 700 million euros), the Battery Booster programme (300 million euros), Horizon 2021-2027 research funding (up to 300 million euros), and the European Defence Investment Programme (up to 1.5 billion euros for defence-critical raw material value chains).
By March 2025, the Commission had also designated 47 strategic projects across 13 EU member states, covering 14 of the 17 strategic raw materials and encompassing 25 extraction projects, 24 processing facilities, 10 recycling operations, and 2 substitution initiatives. In June 2025, 13 additional strategic projects in non-EU countries followed, reaching into Canada, Greenland, Kazakhstan, Norway, Serbia, Ukraine, Zambia, Brazil, South Africa, Madagascar, and the United Kingdom.
The capital requirements for these 60 projects sit at approximately 28 billion euros in total: roughly 22.5 billion for the EU-located 47, and an additional 5.5 billion for the 13 external projects. Against this, the three billion euros of RESourceEU funding, which analysts at the Jacques Delors Centre have noted largely repackages existing instruments rather than representing genuinely new capital, looks conspicuously thin. EIT RawMaterials estimates that reaching the CRMA targets overall will require more than ten billion euros. The Delors Centre's assessment is pointed: "a genuine step-change likely requires the next Multiannual Financial Framework," the EU's seven-year budget cycle that will not be settled before 2028 at the earliest.
The Commission has also announced two new institutional structures. A European Critical Raw Materials Centre, modelled partly on Japan's JOGMEC mineral agency, is to be established in 2026 to provide strategic market intelligence, coordinate investment, manage stockpiles, and act as portfolio manager for EU and global projects. A CRM Financing Hub is intended to rationalise the currently fragmented funding landscape and provide technical assistance to project developers and national administrations. The first matchmaking round between projects and financiers was scheduled for March 2026. Whether either institution can move at the speed the crisis demands remains, as yet, undemonstrated.
The China Clock Running Underneath Everything
The urgency behind all of this is inseparable from what China has been doing since 2023 to its own export architecture. Building on my analysis of China's rare earth counter-architecture in my July 2026 coverage of the G7's Évian commitments, the escalation since then has been relentless. In April 2025, Beijing placed seven medium and heavy rare earths under export controls; in October, it expanded those controls to cover holmium, erbium, thulium, europium, and ytterbium, along with rare-earth processing technologies and equipment. In November 2025, China announced a temporary suspension of the second wave of controls until November 2026, a pause that gave European industry a brief reprieve but also demonstrated, with crystalline clarity, that the timetable is Beijing's to set.
The EU currently obtains 97 percent of its magnesium from mainland China, 85 percent of its light rare earths, and all of its heavy rare earths. Rare-earth magnets, the components that make wind turbines and electric motors function, arrive from China at a rate of 98 percent. Every single tonne of rare earths used in permanent magnets anywhere in the world is refined in China. These are not projections or risk scenarios; they are the present condition, as of July 2026, of the continent that has committed itself to building a green industrial economy.
An SSRN analysis published in April 2026 identified what it called "the 18-month window from January 2026 through mid-2027" as the decisive interval for European strategic commitment: the period in which decisions made or not made on financing, permitting, and institutional design will determine whether the 2030 benchmarks remain plausible or become purely rhetorical. Against that clock, the Community opposition cases in Barroso and Jadar and Zinnwald are not peripheral human-interest subplots. They are the central mechanism by which European strategic ambition is being translated, or not translated, into physical supply.
Toward a Governance Architecture That Doesn't Yet Exist
The Intereconomics paper by Correia, Falck, Tamás Hamor of the University of Pecs, Marzia Cescon of the European Association for Local Democracy, and Luis Rosendo of Generator does not confine itself to diagnosis. Its central institutional proposal is the Community Development Agreement: a binding, legally enforceable contract between a mining company, the host community, and local government, specifying benefit-sharing arrangements, environmental safeguards, and, critically, community veto rights over project terms. The authors draw explicitly on Canadian and Australian precedents while acknowledging that the European context differs in important ways: higher baseline institutional trust expectations, denser populations with more acute proximity impacts, and a regulatory environment that has, for several decades, been systematically expanding protections rather than modifying them.
The three-part strategy the paper advocates combines CDAs for public acceptance with financing guarantees and market protection instruments to improve project economics, and a proposed Global Mineral Trust to coordinate international cooperation on supply chain development. The authors are careful not to suggest that CDAs are a mechanism for overriding opposition; the point is to create a framework in which the negotiation of genuine trade-offs can happen before the planning inquiry, the legal challenge, and the decades of procedural delay that currently constitute the European permitting experience.
The CRMA itself gestures toward this kind of framework without fully constructing it. The requirement for meaningful community engagement is there; the enforcement mechanism for what "meaningful" requires is not. The EU taxonomy for sustainable finance, which could provide mining projects with a recognised green investment designation and unlock institutional capital, was promised in 2021 and has not appeared. As recently as April 2025, the Commission received a working group proposal to update the taxonomy to include mining and refining of some critical raw materials; that proposal remains under consideration.
The European Court of Auditors noted in February that many of the 47 designated strategic projects are still at early development stages, with limited or no off-take agreements with EU buyers, suggesting that designation as "strategic" has so far been more of a signal than a guarantee of delivery. Permit appeals, the auditors pointed out, can still cause delays even within the streamlined 27-month framework, because the CRMA's timeline caps apply to the initial decision, not to subsequent legal challenges. In a continent with robust administrative courts and well-organised civil society, the distinction is significant.
The Valley and the Benchmark
In Covas do Barroso, the consultations continue. The spodumene is still in the ground. The vineyards and the granite farmhouses are still on the surface. Somewhere between these two realities, the CRMA's 10 percent extraction benchmark waits for a reconciliation that European policy has promised but not yet delivered.
The Intereconomics paper's most clarifying observation is also its most uncomfortable one: Europe has spent fifty years building an environmental protection architecture specifically designed to prevent the kind of industrial incursion that its current strategic situation now demands. The consequence is not that European politicians made wrong choices in the 1970s and 1980s when they began relocating mining to countries with weaker environmental regimes. The consequence is that the societal memory those choices produced, and the legal frameworks they generated, now constitute a structural barrier that three billion euros of repackaged EU funds and a 27-month permitting clock cannot dissolve by themselves.
What would dissolve it, or begin to, is an honest acknowledgement of the trade-off: who bears the cost, who receives the benefit, and what compensation or governance authority the affected community receives in return. The Community Development Agreement model is one attempt at that architecture. So far, the Commission's preferred mode has been to announce targets, designate projects, and assume that streamlined permitting will handle the rest. The 85 percent figure is the number that explains why it has not, and why, without a more fundamental reckoning with the geography of refusal, it will not.
In Brussels, officials will point to the Critical Raw Materials Centre, the Financing Hub, the 60 strategic projects, and the RESourceEU commitments as evidence that the machinery is moving. All of that is true and also, on current evidence, insufficient. The valley at Barroso, the ridge above Jadar, the slope at Echassières: these are not obstacles to Europe's mineral strategy. They are, in the precise sense that the Intereconomics authors intend, the strategy's defining problem. Until the governance architecture matches the geography, the benchmarks will keep receding.
