On June 8, the Congressional Research Service released a sweeping resource guide to help lawmakers navigate US critical minerals policy, arriving just as Congress accelerates toward a defining choice: whether to embed a $2.5 billion Strategic Resilience Reserve into the National Defense Authorization Act or advance it separately through committee markup. The bipartisan SECURE Minerals Act, modelled on both the Federal Reserve and the Strategic Petroleum Reserve, represents the most architecturally ambitious stockpiling proposal Washington has seen in a generation, and the legislative window to pass it may be narrowing fast.

Introduction

The room on Capitol Hill where the Senate Armed Services Committee meets to mark up the National Defense Authorization Act is not, by Washington standards, a glamorous place. It is a chamber of long tables, dim lighting, and the peculiar tension that comes from legislators trying to compress a year's worth of national security decisions into a few weeks of floor time. This June, alongside the usual debates over aircraft carrier funding and troop deployments, a quieter argument is unfolding: whether to use that annual must-pass vehicle to create something the United States has never had before, a permanent, self-financing, Federal Reserve-style corporation with the legal authority to buy, store, and sell the minerals that underpin the entire architecture of modern defence, technology, and energy.

The proposal is the Securing Essential and Critical US Resources and Elements Act, known by its acronym as the SECURE Minerals Act, introduced in January 2026 by a bipartisan quartet of senators and representatives: Jeanne Shaheen of New Hampshire, Todd Young of Indiana, Robert Wittman of Virginia, and John Moolenaar of Michigan. Its core mechanism is a Strategic Resilience Reserve Corporation, authorised at $2.5 billion, governed by seven Senate-confirmed board members serving staggered fourteen-year terms, and equipped with a toolkit that includes loans, direct acquisitions, advanced market commitments, and non-recourse lending. Allied nations could participate by contributing a minimum of $100 million to the reserve.

The bill arrived in Washington at the same moment the Congressional Research Service published, on June 8, a new resource guide designed to orient lawmakers through what one analyst described as a policy arena scattered across a half-dozen agencies, multiple international bodies, and a thicket of competing definitions. The CRS document is not legislation. It does not allocate funds or mandate action. But in the volatile, crowded legislative space of critical minerals policy, it performs a function that is easy to underestimate: it hands every member of Congress and their staff a common map of the terrain, at precisely the moment when competing bills, executive orders, and agency initiatives are pulling in different directions.

The Map and the Moment

The CRS resource guide, catalogued as R48974, is both a technical document and a snapshot of how thoroughly critical minerals have migrated from the margins of industrial policy to the centre of national security debate. It compiles links and summaries of CRS products, Congress.gov legislation searches, executive orders, and data from the International Energy Agency, the World Trade Organization, the United Nations, the European Commission, and the Asian Development Bank, among others. Its framing is deliberately neutral. But its choice of scope is a political statement in itself: by pointing lawmakers to the FAST-41 permitting dashboard as a live tracker for the administration's domestic extraction goals, and simultaneously flagging multilateral bodies as context-setters for a global competition, the document acknowledges that no single legislative fix can resolve the underlying structural dependency.

The central tension, as the guide frames it, is straightforward: the United States needs minerals it largely does not control. The demand for critical minerals and rare earth elements is rising because of their role in batteries, semiconductors, medical equipment, solar and wind energy systems, and certain military equipment. The USGS publishes a list of fifty critical minerals, finalised in February 2022, and the Department of Energy's 2023 Critical Materials Assessment evaluated twenty-three materials across eight major technologies, with an updated version expected later in 2026. The DOE solicited public feedback in a June 2025 Federal Register notice to prepare that assessment, asking for data on supply chain information, market dynamics, and challenges to domestic industry. The 2026 update will land in a very different policy environment than the 2023 original.

For the Trump administration, the CRS document functions as a quiet validation of its strategic framing. The administration has pursued bilateral minerals agreements with allies, including a proposed deal with the European Union and a finalised agreement with Japan, as alternatives to the multilateral frameworks it has repeatedly bypassed. It has issued executive orders accelerating domestic extraction, and in February 2026 it launched Project Vault, a $12 billion civilian stockpile backed by a $10 billion Export-Import Bank loan, with participation from Boeing, General Motors, Google, GE Vernova, Corning, and Stellantis. Building on my analysis of Project Vault in my June 2026 piece on the structural gaps in that initiative, the CRS guide makes legible something that the administration's own announcements have tended to obscure: the distance between a warehouse full of raw materials and a functioning domestic industrial base is not bridgeable by executive order alone.

The Architecture of the Reserve

The SECURE Minerals Act did not emerge fully formed in January 2026. An earlier version, H.R. 10378, was introduced in December 2024 but stalled in committee without securing enough support. The 2026 reintroduction arrived with a more deliberate political architecture: bipartisan sponsors, a bicameral structure with companion bills in both chambers (H.R. 7126 in the House, S. 3659 in the Senate), and, by February 24, 2026, the first Democratic cosponsor in the House, Congressman Chris Pappas of New Hampshire, who signed on ahead of a subcommittee hearing on energy and mineral resources.

The bill's designers drew explicitly on two historical precedents. The Strategic Petroleum Reserve, created in 1975 in the aftermath of the Arab oil embargo, demonstrated that the federal government could use physical stockpiles to buffer an economy against supply shocks. The Federal Reserve demonstrated that an independent, expert-governed board, operating with insulation from short-term political pressure, could manage a complex and volatile market instrument with more consistency than a standard executive agency. The SECURE Minerals Act attempts to marry these two models. Its seven-member board, appointed by the president and confirmed by the Senate, would serve staggered fourteen-year terms, with a chair and vice-chair serving four-year terms of their own. Board members must bring expertise in critical minerals production, use, recycling, or financing.

The reserve's operating logic is designed to be self-sustaining over time. The board would buy and store critical minerals in facilities across the country, with priority given to recycled materials, though mined minerals would also be eligible. It would sell minerals for commercial and defence use, with proceeds reinvested to sustain operations and fund additional purchases. The bill's legislative findings make the commercial rationale explicit: government support for Western and partner-country minerals markets is, in the bill's own words, a countermeasure against the anti-competitive tactics of the People's Republic of China that cannot otherwise be achieved by private industry participants acting alone. The reserve would also aim to ensure that the United States and partner countries supply at least twenty-five percent of domestic critical mineral needs, reducing dependence on covered countries, meaning primarily China, to no more than seventy-five percent.

Allied participation is built into the structure rather than left as a diplomatic afterthought. G7 countries and other allies could contribute a minimum of $100 million to the reserve, subject to approval by the reserve board. That provision reflects a broader logic in the bill: the reserve is conceived not merely as a domestic buffer but as a potential anchor institution for a Western minerals market, capable of establishing a price benchmark for materials that are currently, as one Senate analysis put it, thinly traded and heavily influenced by Chinese production and export policies.

The Legislative Race

The SECURE Minerals Act faces a familiar Washington paradox: it is widely praised and not yet passed. The American Critical Minerals Association endorsed it, calling the reserve an engine of growth for domestic and allied investments. The progressive economics group Employ America endorsed it, describing the bill as deploying a robust and varied toolkit for the development of independent, liquid, free, and competitive commodity markets. Senators Cortez Masto and Rounds added their names to the Senate bill. And yet legislation of this scope, as Sahar Hafeez, a senior international trade counsel at Pillsbury Lawson who co-leads the firm's minerals practice, noted, typically takes time to advance and is likely to undergo multiple revisions before becoming law.

The current legislative race runs on two tracks. The first is the Senate Armed Services Committee, where leadership is aiming to include the reserve legislation in the National Defense Authorization Act for fiscal year 2027. The NDAA is, in principle, a near-guaranteed vehicle: it has passed every year for more than sixty consecutive years. In practice, inclusion in the NDAA subjects any provision to the full gravitational field of Pentagon budget politics, which can reshape, dilute, or simply bury provisions that lack a well-organised constituency within the defence establishment. The second track is the House Natural Resources Committee, which is scheduling a markup on the bill, a procedural step that would allow members to amend the legislation in committee and potentially advance it to the floor under its own power.

The FY 2026 NDAA, signed into law on December 18, 2025, offers a preview of what the FY 2027 version might accomplish. That legislation added gallium, germanium, and molybdenum to the covered materials list for defence procurement, with restrictions on gallium and germanium scheduled to take effect in December 2027. It established a new Stockpile Manager within DOD, expanded the Strategic Materials Recovery and Reuse Program, and reauthorised and expanded the US Development Finance Corporation, a critical tool for financing minerals projects overseas. The House Armed Services Committee's FY 2027 proposal goes further, with Section 1801 proposing a tiered sourcing framework that would significantly amend current sensitive materials restrictions, establish phased sourcing requirements through 2031, introduce new domestic content standards, and create transition rules for companies seeking waivers. The One Big Beautiful Act, separately, appropriated $2 billion to the National Defense Stockpile Transaction Fund, adding another layer of parallel activity to a policy space that is rapidly becoming crowded.

The National Defense Stockpile itself, created by statute in 1939, has been the primary federal mechanism for strategic materials reserves. The SECURE Minerals Act deliberately does not amend it. The bill's sponsors chose instead to create new statutory authority and a new institution, rather than layering additional obligations onto a legacy framework. That architectural choice is significant: it reflects a judgement that the existing stockpile system, designed for a Cold War threat model, is not adequate to the task of managing a dynamic, market-facing reserve in a world where China can engineer price manipulation through export quota adjustments, as it has demonstrated repeatedly with rare earths.

China's Shadow and the Structural Gap

Senator Shaheen's framing of the bill's rationale is worth quoting in full, because it captures the mood in which this legislation is being considered. China's global dominance of critical minerals supply chains, she said, gives it significant leverage and leaves the US vulnerable to economic coercion. Senator Young was blunter: creating this reserve is a much-needed, aggressive step to protect our national and economic security. Representative Moolenaar, who chairs the House Select Committee on China, reached for a more visceral metaphor: China fired a loaded gun at the world economy last October by putting a chokehold on the supply of critical minerals and threatening supply chains our nation depends on.

The numbers behind those statements are not disputed. China currently controls more than sixty percent of the world's mined rare earths and approximately ninety percent of their processing. It holds a major share of refined production of lithium, graphite, and cobalt. In 2024, according to the White House, the United States was entirely reliant on imports for twelve critical minerals, and imported fifty percent or more of twenty-nine others. The push to secure mineral supplies intensified when China tightened export controls in late 2024 and again in 2025, prompting some US manufacturers to reduce output. The export controls on gallium, germanium, and antimony that followed, and which I covered in detail in my piece on China's selective re-activation of rare earth controls against Japan in late May 2026, have made the systemic nature of Beijing's leverage harder to deny.

The SECURE Minerals Act's toolkit is designed specifically to address the mechanism of that leverage. China's ability to suppress or spike mineral prices through production and export policies creates a risk environment in which Western mining and processing investment is chronically underfinanced: capital is reluctant to commit to projects when the cost of production may exceed the market price at any moment Beijing decides to flood the market. The reserve's authority to issue advanced market commitments and non-recourse loans is intended to decouple investment decisions from that price risk. The reserve's recycling priority, meanwhile, reflects a growing consensus among analysts that innovations in recycling, processing, and material substitution throughout the supply chain are essential to loosening China's market dominance, even if they cannot entirely displace primary extraction.

Analysts have also raised concerns that the US government's simultaneous accumulation of more than $1 billion in equity investments in select domestic mining and materials companies, a policy that has drawn congressional scrutiny, risks market distortion and political allocation of capital. The SECURE Minerals Act is designed with an independent governance structure precisely to address this risk: the Federal Reserve model is meant to insulate the reserve's acquisition and disposal decisions from the political pressures that can corrupt a more directly administered stockpile. Whether that insulation will hold in practice, given the intensity of executive branch interest in the minerals sector, is a question the bill's architects cannot answer in advance.

A Generation's Decision

There is a recurring debate in Washington about whether any given legislative moment is genuinely historic or merely another data point in a long cycle of crisis and response. The critical minerals debate has been declared urgent for at least fifteen years, and the General Mining Act of 1872 still governs hardrock extraction on federal lands. The gap between rhetoric and durable institutional change is, in this policy area, unusually large.

What makes the current moment different, or at least potentially different, is the convergence of institutional instruments with political will. The CRS resource guide published on June 8 represents the kind of staff-level consensus-building that precedes serious legislation: when the research arm of Congress takes time to compile a common reference architecture for members, it signals that the chamber is preparing to act, not merely to posture. The SECURE Minerals Act has sponsors on both sides of the aisle and in both chambers. The NDAA track offers a vehicle. The House Natural Resources Committee markup offers a parallel path. The DOE's forthcoming 2026 Critical Materials Assessment will add an additional layer of analytical pressure.

The concurrent legislative activity is also notable for its breadth. The PRIMED Act, introduced by Senators Slotkin and Ernst, would cut through permitting red tape for defence and energy supply chain projects by qualifying them under the FAST-41 expedited environmental review process. The Critical Minerals Security Act of 2025 would direct the Department of the Interior to assess global supply and ownership of mining, processing, and recycling operations. The Critical Minerals Partnership Act of 2025 would build a broader multilateral cooperation framework for allied supply chains. Taken together, these bills represent a legislative ecosystem that, if even partially enacted, would reshape the institutional landscape of US minerals policy more substantially than any single decade since the Korean War.

Pillsbury's Hafeez noted the practical constraint with her characteristic precision: legislation of this scope typically takes time to advance and is likely to undergo multiple revisions before becoming law. That observation is both accurate and incomplete. The SECURE Minerals Act's sponsors have staked something on the claim that the time for incremental revision has passed, that the architecture of China's market dominance is moving faster than Washington's deliberative processes can comfortably match. The July 1, 2026 effective date of China's State Council Order No. 837, which I examined in my June piece on the regulatory architecture Beijing is completing, is a useful benchmark: the rules governing Chinese mineral investment and export are being finalised at a pace and with a coherence that the current US legislative calendar has not yet matched.

In the committee room where the NDAA markup will eventually take place, the arguments will be about cost, governance, procurement timelines, and the proper role of government in commodity markets. Those are legitimate arguments, and they will not be resolved quickly. But outside that room, in the minerals markets of Kinshasa, Guangzhou, Tokyo, and Santiago, the decisions that will determine whether the SECURE Minerals Act matters at all are already being made. The reserve's architects are betting that a $2.5 billion institution with a Federal Reserve governance model and a mandate to anchor Western price formation is not a luxury Washington can defer. The legislative race now underway will determine whether that bet gets placed before the window closes.
