In the span of sixty days, the Trump administration signed executive orders, launched a $12 billion reserve, convened 54 nations, and opened formal negotiations on a legally binding plurilateral trade agreement covering processed critical minerals. With a USTR comment deadline passing March 19 and a 180-day tariff clock already running, the architecture Washington has constructed is either the most consequential industrial policy intervention of the century or an ambitious bet that allies will follow where the United States leads.
Introduction
The conference room at the State Department's Loy Henderson auditorium was standing room only on February 4. Secretary of State Marco Rubio, flanked by Vice President JD Vance and five cabinet colleagues, looked out at delegations from 54 countries and the European Commission, including 43 foreign ministers who had flown to Washington to discuss something that would have seemed an unlikely diplomatic priority a decade ago: the global trade in processed rocks and metals. The room, officials noted afterward, had never hosted so many mineral-producing nations at once.
What unfolded over the following hours, and across the sixty days before and after that gathering, represents an exercise in policy architecture that Washington has rarely attempted at such velocity. Executive orders, reserve funds, bilateral frameworks, multilateral working groups, and a formal public comment process for a legally binding plurilateral trade agreement were all set in motion within a compressed window. The critical minerals policy sprint that began with a January 14 presidential proclamation is now approaching its first major test: a USTR comment deadline on March 19 that will shape the contours of an agreement designed to break China's structural dominance over the materials that underpin modern defense, clean energy, and advanced manufacturing.
For the officials designing this framework, the urgency is not rhetorical. The United States is fully import-dependent for 12 critical minerals and relies on imports for more than half of its consumption of an additional 29. China, according to the International Energy Agency, is the leading refiner for 19 out of 20 important strategic minerals, with an average global market share of 70 percent. In permanent magnets, the concentration is even more extreme: China accounts for 94 percent of sintered magnet production, up from roughly 50 percent two decades ago. These are not the statistics of a manageable commercial disadvantage. They are the coordinates of a structural vulnerability that Beijing has already demonstrated a willingness to exploit.
The January Proclamation and the Logic of Processing
When President Trump signed Presidential Proclamation 11001 on January 14, the language embedded in the document was unusually candid for an executive action. The Secretary of Commerce had found that the United States was suffering from "unsustainable price volatility," "weakened domestic manufacturing and production capacity," and a lack of access to a "sufficiently secure and reliable supply chain" for processed critical minerals and their derivative products. The proclamation was the formal result of a Section 232 national security investigation, the same trade authority the administration had previously used for steel and aluminum.
But what distinguished this action from those earlier tariff campaigns was its explicit focus on processing rather than extraction. "Mining a mineral domestically does not safeguard the national security of the United States if the United States remains dependent on a foreign country for the processing of that mineral," the EO stated plainly. It was an acknowledgment of a reality that had long been understated in Washington: China's leverage does not rest primarily on what it digs out of the ground, but on what it does with raw ore once it arrives at the refinery gate. China controls an estimated 40 to 90 percent of the world's processing capacity for lithium, cobalt, and copper, a range that reflects both the breadth of Beijing's dominance and the difficulty of measuring it precisely.
The January proclamation also expanded the working definition of critical minerals in a way that signals the administration's economic ambitions. The order incorporated copper, uranium, gold, and potash alongside the Department of Interior's existing list, bringing the effective policy universe closer to the 60-mineral framework that the USGS had adopted in its November 2025 list update, an expansion from 50 minerals that added silicon, silver, boron, phosphate, and metallurgical coal, among others. The USGS noted that minerals-based industries had contributed over $4 trillion to the U.S. economy in 2024, a figure that gives the policy stakes a monetary weight that is harder to ignore than national security abstractions alone.
Crucially, the January proclamation embedded a countdown. The President directed the Department of Commerce and the U.S. Trade Representative to jointly pursue agreements with foreign partners within 180 days. If those agreements are not reached, or fail to deliver results, the President retains explicit authority to impose more stringent import restrictions. That clock began running on January 14. It expires, roughly, in mid-July 2026.
The Plurilateral Gamble: USTR Opens the Architecture
Four weeks after the January proclamation, USTR opened Federal Register Docket USTR-2026-0034, inviting public comment on the design of a legally binding plurilateral Agreement on Trade in Critical Minerals. The comment deadline is March 19, and the submissions being prepared by industry groups, trade associations, and policy researchers in the final days before that deadline offer a window into both the ambition and the contested details of what Washington is actually trying to build.
The core instrument USTR has put on the table is a price floor: a minimum price mechanism, paired with border measures, designed to create what the notice describes as "secure and fairly-priced markets" among participating countries and to generate demand for "market-based" investments in mining and processing. The implicit target of this architecture is Chinese pricing power. Beijing has spent two decades using state financing and subsidized processing to push global mineral prices below the level at which Western producers can profitably invest in new supply. A coordinated price floor among allied consuming nations would, in theory, shift that calculus.
The practical questions are considerable, and the stakeholder responses reflect that complexity. The SAFE Center for Critical Minerals Strategy argued in its submission that USTR should limit the agreement's initial scope to a small number of minerals, selected based on the availability of alternative supply outside China and a large enough demand base within the trade zone. SAFE also recommended that price floors target processed and refined forms rather than raw ore, and that the pricing mechanism be anchored in a sustainable production price floor rather than a market-linked index subject to volatility. The organization warned that "the design of any plurilateral agreement on critical minerals must begin with a clear articulation and alignment on the problem that members agree to solve."
The U.S. Chamber of Commerce, submitting separately, was supportive of the framework's direction but cautious about the instrument. Trade actions may be needed to reinforce price floors, the Chamber noted, but tariffs by themselves are "an incomplete and potentially counterproductive tool" absent broader alignment with partners. The Chamber cited projections that global demand for graphite, lithium, and cobalt will need to increase by nearly 600 percent by 2050, and argued that permitting reform, tax policy, and regulatory streamlining are as critical to supply chain resilience as any trade mechanism. For Gracelin Baskaran, Director of the Critical Minerals Security Program at CSIS, the January EO represents something more fundamental than a tariff negotiation. "The EO signals a shift toward global supply chain cooperation as a pillar of U.S. economic and national security strategy, rather than unilateral self-sufficiency," she told me, noting that the administration had explicitly rejected an America-only posture in its framing of the agreement.
Two working groups are now active. One comprises the United States, the European Union, and Japan; the other, the United States and Mexico. Both were tasked with developing action plans within 30 and 60 days of the February 4 ministerial, respectively. Those plans are due as this article goes to press, and their scope will determine whether the plurilateral framework becomes a serious trade architecture or remains a diplomatic signal without binding teeth.
The DOE's $500 Million Signal, and the Supply Gap It Reveals
On March 13, two days before the Indo-Pacific Energy Security Ministerial opened in Japan, the Department of Energy's Office of Critical Minerals and Energy Innovation released a Notice of Funding Opportunity for up to $500 million to expand domestic critical mineral processing, battery manufacturing, and recycling. It was the third round of funding through DOE's Battery Materials Processing and Battery Manufacturing and Recycling programs, and it arrived with language from Energy Secretary Chris Wright that captured the administration's operational mood. "For too long, the United States has relied on hostile foreign actors to supply and process the critical materials that are essential in battery manufacturing and materials processing," Wright said in the announcement.
The $500 million NOFO solicits proposals across three areas: domestic processing of critical minerals from raw feedstocks, domestic recycling, and domestic battery materials and component manufacturing. Letters of intent are due March 27; full applications follow on April 24. The funding is modest relative to the scale of the problem. Greenfield mining projects routinely cost more than $1 billion for construction alone, and mega-projects run into the billions. Most take a decade or more from exploration to first production. The Wilson Center has noted that rebuilding downstream industrial capacity will require sustained policy support across multiple administrations, a political durability that no single executive order can guarantee.
At the Indo-Pacific ministerial in Japan, Assistant Secretary of Energy Audrey Robertson offered a formulation that will define the administration's stated approach to this tension: "Boosting domestic production, including through recycling, will bolster national security and ensure the United States and our partners are prepared to meet the energy challenges of the 21st century." Robertson stressed that collaboration with partners remains critical even as domestic production expands, a position that aligns with the plurilateral framework USTR is simultaneously constructing. The March 13 announcement, read alongside the January proclamation and the February ministerial outcomes, suggests an administration that understands domestic investment alone cannot solve the processing gap, but is using funding rounds to maintain political momentum and attract industry participation while the diplomacy matures.
The structural dimensions of what DOE is trying to address are worth pausing on. The USGS 2025 list identifies gallium, germanium, tungsten, several rare earth elements including terbium and dysprosium, and other heavy rare earths as carrying the highest supply risk. These are not abundant minerals with diversified global producers; they are materials where Chinese control of processing is close to absolute, and where no credible Western alternative exists at commercial scale within the timeframe that defense and technology industries require. "We do not see licensing requirements themselves as negotiable," said Cory Combs, Head of Critical Minerals and Supply Chain Research at Trivium China. "They are the means for Beijing to tighten or loosen control over particular countries', companies', and industries' supplies, not the actual damage to be done." Combs's framing captures the structural logic of China's approach with precision. The suspension is a tactical pause, not a policy reversal. The licensing architecture remains in place. The leverage remains intact. And the suspension expires in November 2026, creating a hard deadline for Western diversification efforts that the USTR's 180-day window, the DOE funding rounds, and the FORGE ministerial working groups are all, in different ways, racing toward.
China's rare earth magnet exports reached 10,763 metric tons in the first two months of 2026, an 8.2 percent increase from the prior year, as manufacturers rushed to build inventory during the suspension window. European rare earth prices had reached up to six times Chinese domestic levels during the April to May 2025 period when the original export controls were first imposed, a price dislocation that exposed the fragility of supply chains that had been optimized for cost efficiency rather than resilience. February 2026 saw China export 20 tons of yttrium oxide and related compounds, the largest monthly volume since April 2025, but volumes still remained below 2024 levels, reflecting Beijing's continued calibration of access rather than a genuine opening.
The EU is watching all of this with a combination of urgency and frustration. But an EU Commission source did not hide the scale gap. "Today, the Trump administration is also a cause for concern, as it has significantly accelerated the race for supplies, supporting financing through the Export-Import Bank," the source told reporters this month. EXIM Bank alone announced at the end of November 2025 that it intends to invest $100 billion in critical raw materials and energy, a figure that dwarfs the 3 billion euros allocated to RESourceEU. The source described this as demonstrating "a clear inability on the part of Europe to mobilize sufficient resources." That assessment, coming from inside the Commission itself, suggests that whatever the EU's policy ambitions, it enters the plurilateral negotiations with a financing posture that does not match the moment.
Ukraine, the DRC, and the Geography of the New Supply Chain
Two geographies that would have seemed improbable candidates for critical mineral diplomacy five years ago are now central to Washington's supply chain calculus. In Kyiv, the U.S.-Ukraine Reconstruction Investment Fund, the minerals deal that Treasury Secretary Scott Bessent called "historic" when it was signed on April 30, 2025, became fully operational in early 2026. The fund's board reached consensus on administrative steps on December 18, and as of this writing, it is actively diligencing its first investments. DFC CEO Ben Black framed the activation of the fund in terms that blurred the line between investment banking and national security: "The U.S. and Ukraine are ready to deploy investments that will advance shared national interests."
In Central Africa, the calculus is more complicated. The U.S. and the Democratic Republic of Congo signed a bilateral strategic partnership agreement in December 2025, following a period of intensified engagement that began when the DRC government offered Washington access to its mineral resources in exchange for support against the M23 rebel group. In February 2026, the DRC included Rubaya, a mining site in North Kivu estimated to supply over 15 percent of global tantalum production and currently under M23 control, in the list of strategic assets offered to the United States as part of that agreement. Mahnaz Khan, Vice President for Policy on Critical Supply Chains at the Silverado Policy Accelerator, has argued that the administration's approach is best understood as unfolding in phases. The first phase, she contends, focused on strategic signaling: executive actions placed critical minerals at the center of national policy and instructed federal agencies to map supply chain vulnerabilities. The second phase, which is now underway, involves the mobilization of capital and the construction of diplomatic frameworks. The third, which will define whether this effort succeeds or collapses into a policy record of good intentions, involves the actual permitting, construction, and operation of mines, refineries, and processing facilities in jurisdictions that have spent decades discouraging exactly that kind of industrial investment.
Mid-July and What Comes After

The delegations have returned to their capitals. The working groups are in session. The USTR comment docket closes in four days. The DOE funding letters of intent are due in twelve. And in mid-July, the 180-day countdown on the January 14 proclamation will expire, at which point the President retains the explicit authority to impose import restrictions on processed critical minerals if the diplomatic track has not produced results.
Whether the architecture Washington has constructed over the past sixty days can survive contact with the structural realities of the critical minerals market is the question that will define the second half of 2026. The fundamentals are daunting. Most mining projects take a decade or more to reach production. Processing facilities require years of permitting and construction even in the most permissive regulatory environments. China's suspension of export controls expires in November, and Cory Combs's observation that the licensing system itself is not on the negotiating table suggests that Beijing will retain the ability to reimpose constraints on whatever terms it chooses.
But the policy architecture being assembled in Washington is, for the first time, attempting to address the processing problem rather than just the mining problem, to coordinate with allies rather than act unilaterally, and to use trade agreements as a durable structural tool rather than relying solely on stockpiles and subsidies. The USGS 2025 list of 60 critical minerals, the Project Vault reserve, the FORGE ministerial framework, the RESourceEU platform, the Ukraine reconstruction fund, and the USTR plurilateral process are, taken together, more coherent than anything the United States has attempted in this space since the Cold War ended.
Gracelin Baskaran at CSIS put the challenge in terms that cut through the policy architecture to the underlying strategic question: "No single country can secure these supply chains alone." That sentence is either the beginning of a genuinely multilateral solution or, depending on what happens in the working groups, the diplomatic justification for a failure that no single country will have to claim as its own. The February room was full. The question now is whether the commitments made inside it will outlast the diplomatic momentum that filled it.
